I have a valid approved petition (until May 2016) and a valid visa stamp (until Dec 2016) but have never been to US on this VISA and have never worked for the petitioner (the US branch for my current Indian employer). If i switch my job now and my new Indian employer (or rather their US branch) files a new H1B petiiton/LCA for me; will that be cap-exempt (considering i have never been to US on H1b before)?
