When can we go for Cap Exemption...

Hi All,

I got my petition in October 2015 which will expire in June 2018…

During this period, I never travel to US… Till Feb 2018, I was in Australia…

I have PA interview scheduled on 17th April…

I know I can apply for extension but for that person should be in US prior to 60 days of petition expiration date… Is this a rule?

So now there is no position at Onsite with my skill sets so my petition will expire soon… so please let me know when can we go for Cap Exemption…

  1. If my petition expires without any stamping done.

  2. My stamping is done but I do not travel.

Please let me know best possible case for me…
