I got approved H1b visa in September 2012. When can I apply for I-140? Do I have to wait unil H1B expires after 2 years or I can apply right know? If I could apply right now do I need Now LCA approverd for I -140? Please advise.
It has to go through the entire process - job description, prevailing wage determination, advertisement, quiet period, PERM, and then I-140.
This all can be started anytime as soon as your employer is ready.
