Last year my employer filled a H1b petition and in Sep 2012 an RFE was triggered.
Due to some mistake we never received the RFE copy from the USCIS and the petition was rejected as we didnt respond to RFE in time on Dec 2012.
This year again my employer filled a H1b applicantion for me and my petition got approved.
but while filling the DS 160 form there is a question :
[b]Have you ever been refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry? [/b]
What should be my response to this question?
Does I29 petition rejection means visa rejection?
What will be the impact of last year rejection on my current year application?
Do i have to carry the response of the last year RFE since we never filled the response to USCIS.
