What happens when my EAD expires?

Hi There,

Thank you for the useful information in your website. I have a question about my H1-B. I’m currently under Stem Extension and it expires June 2013. My company will file for H1-B 2014 in April 2013. What will happen between June 2013 (when my EAD expires) and October 2013? Can I still work?

If the H-1 is applied w/ COS from F-1 to H-1 and your employer requests Oct 1 as the employment start date, then you will become eligible for cap-gap. This will allow you to stay and work in US after OPT expires. You can do so until Oct 1 or H-1 denial date (whichever is earlier).

Let your school know once your H-1 gets filed so that they can update the SEVIS record w/ cap-gap.
