What happens to my H1B petition?

Hi,

My H1B petition was filed by my current employer on April 1st 2013. It is still in Intial review. But, I got issues with my current employer and I might shift to another employer. What happens to by H1B petition ? Can it still be approved as I will be changing the employer? If incase it gets approved can I shift to H1B status by October 1st under my new employer or he needs to apply for transfer?

Your employer may withdraw the pending petition once you leave them. Also, if RFE is raised they may not be inclined to respond to that.

However, if it gets approved and if you know the receipt number, any other employer can file a cap-exempt petition for you in future.
