What are the fees refunded in case H1B is not picked

Hi,

I hear that some of the candidates pay for H1B petition even though it is not correct as per Federal Law. With the amendment in the fee of H1B petition filing, this is definitely going to screw the new H1B aspirants.

I would like to know what are all the fee refunded in case H1B is not picked in lottery and if H1B is picked but not approved assuming petition is filed by genuine consultants but who charge from candidates? What kind of losses does candidate have to go through during the different stages of rejection of the petition in case the candidate is paying out the pocket.

If petition is not picked-up, USCIS doesn’t keep a penny. Everything is returned to the petitioner (i.e. employer).

If the petition is picked-up but later denied, then nothing is refunded.
