What are my options for stay in USA, as my wife is pregnant?

Hi Everyone,

My H1b Visa will expire in 28th Feb 2021and I94 expired after 10 days.My company is filling my extension and my wife is expect in the march if my extension get reject what are my option to stay in US as we cant travel back to India due to my wife pregnancy.

You will have an option to apply for B2 COS as your situation is beyond your control.
Let’s say, you get the denial, then immediately submit a change of status to B2 and put it as Nunc Pro Tunc telling the situation is beyond your control and ask for B2 COS. you can submit the pregnancy letters, hospital letters as support. You can approach an attorney and seek their help, if you are not sure.
