US payroll after H1B maxout

Hi,

My visa max out as on June 10th, still waiting on my PERM approval for the last 7 months. Could you please advise on payroll related queries?
Do my employer able to run my US payroll while I am in India and working from there?
If they do, is that going to impact my future H1 filing after I140 approved?

I don’t think your employer would be able to run your US payroll if you are physically working from India. The H1B amendment clearly states you should be physically located within 50 miles of the registered work/ home address. I might be wrong, please consult an attorney.
