UNUSED L2 VISA AND EAD TO HIB CAP EXEMPT

Hi

I am currently in H4, I had been in US in the year 2009-2010 in L2; during that time I had obtained EAD approval for working. But did not worked and went back to India.

Can i try applying for H1B Cap Exempt? Is that possible. If so, what would be the Visa Fees and Processing time.

Unless you had your H1B approved in previous 6 years you are not eligible for cap exempt H1B visa.

You will have to wait till April 2014 to file H1 and you can start working after 1st oct 14

but you can apply for not-for-profit H1B as i is cap exempt. But shuch positions are rare.
