I have a situation where I need input. I recently reentered US on L2S visa after 1 and half years. Earlier I was on H4. I was in canada for 1 and half yrs and entered US through land. My recent i-94 has L2S as class of admission. When I went to apply for SSN the officer said she is not able to verify and she will raise a case to verify on the same. I was following the case status in SAVE and found it updated as “Returned to agency”. I went to Social security administration today to know more but the officer said they received response as my visa is showing as H4. But my recent i94 and passport on visa has L2S visa as my class of admission. I contacted USCIS to check and they said it’s showing as H4. When I asked to update USCIS said they can’t update without a seperate petition for me. He added USCIS is only for change of status and extension or new petition.
L2 will not have seperate petition is my understanding and also not needed to have ead as per the latest update. Again i94 has correct information.
So now who is responsible to change the status in USCIS. What is my next step for obtaining a SSN
Yes I checked with them and the officer says their system is correct and they cant do anything about why it’s not updated in USCIS. Contacting USCIS has become a very horrible experience since I was able to reach agent once and USCIS officer said they cannot update my status just I said so.
You can schedule an in-person appointment at the nearest USCIS office in your area and carry your L2 I-94 issued by CBP , copy of your spouse L1 I-797, your current passport you used at the last entry in the US and explain them the issue you are facing. This should help them fix your status in their system.
Also, try to check SAVE, sometimes, it can be a simple fix there. If the SAVE System is updated, many of these go way. You can check SAVE at: SAVE CaseCheck for Benefit Applicants | USCIS
Yes I am checking in SAVE. But issue is it shows case is returned to agency after sometime and when I go to ssa they say it’s still pending with immigration and they didn’t hear back. After a day it becomes case under review.
