Hi all, I would like to know if it is possible to apply for a fresh petition under cap exempt quota with an expired unused H1B visa. Also I have never travelled to US. I got my H1B visa through company A in feb 2011. I quit the company to pursue MBA in a premier institute in india. Subsequently the Visa got expired in feb 2012 and I never travelled to US. I would like to know if a new company B can initiate a fresh petition under cap-exempt H1B.
