Switch Employer with RFE on Visa Extension and Stamped visa expired

My H1-B is stamped till August 14th (another 1 week), and my current employer filed extension on June 1st. Yesterday I received RFE for this extension petition.

Last week I got offer from another employer, could you please help me with below questions

As extension petition is under RFE status, can future employer initiate visa transfer immediately or need to wait till extension is approvedWho should respond to RFE, current employer or future employerAfter August 14th will I be out of statusHow much time is required before I join the new company

  1. Future employer can initiate immediate visa transfer.

  2. RFE response is task for present employer.

  3. Not exactly. You are in status during the time applications are pending with USCIS. Make sure you have record of all dates.

  4. 65 days extendable to 180 days with due cause.
