Stamping for H1B extension before the current visa validity date

Hi,

My current visa and I94 expires by July’8 2015…I have applied for H1 extension and got it approved, my new extension petition is valid only from July’ 9 2015…

I am planning to go india next month(April) and come back to US by May 5th, can I get stamping done for my extension petition…

If I get stamping done, will be my current visa will become invalid and How can I travel back(if the current visa cancelled)?..Or both the old and new visa’s will be valid?..

As far i knew, Every person can hold max of upto 10 H1B’s in his/her name. But payroll should run based on only single H1B. Regarding your case, since your new H1B would be effective from July 9,2015, after your stamping you can’t travel till July 8, 2015 in case you are planning to use this H1B. You didnt mentioned about your current H1B details, whether it got stamped or not? If at all you have the stamped H1B, then probably don’t go to stamping at the moment(as you are planning to return by May itself) and after returning back. By that you would be having new I94 date. so you can ask your lawyer whether you need to file any COS on your new H1B or not?

At bottom line, its not safe to travel now, atleast not safe to return before July 8 with the new H1B stamping.
