I am in a critical situation. I got my H1b stamped in Nov-2013 and have the validity till Sep-2016. I have not traveled to US
yet. I got an offer from another company B. It seems like my current employer will threaten me to the pay cost of H1B.
Is it legal? Should I pay the penality to my employer? If It is illegal, Where should I complaint about this ?
Please advice.
The first company will encounter a loss by having spent money on your visa and also not having you on payroll now. If a security deposit was involved, they will capture it. However, the company cannot force you to pay cost of your loyalty shift even if you signed a bonded contract as bonds have no validity unless trade secrets were involved. Please do appreciate though that some effort went into getting you approved. If it is not too much bother, apologize to the first company and talk about a repayment plan. Nobody can force you to do this, it is just a matter of personal ethics. Why hurt someone financially for no reason… it is up to you though.

I agree with Dr. Sandeep. No one can force you and you are not obligated to pay. its upto you. Harm your company can do is they can cancel your H1b. So you better file a transfer petition asap.
