I resigned from my company when I had an upcoming H1B Visa appointment scheduled.
I was informed by my company that they would eventually request USCIS to withdraw my petition.
I’m keen to know what would be the process of getting a H1B Visa from a new employer.
My previous company told me that I will not have to get into the lottery process again. Is that true? If yes, then what would my new employer need to verify my claim of an already won H1B lottery.
I believe my new employer will only need to file a new petition on my behalf and then get a Visa appointment. Can the petition be filed for premium processing? If yes, can it be done any time of the year?
Appreciate any response in advance.
Yes.
You can provide the copy of your initial H1B I-797 approval notice to your new employer so they can file cap-exempt H1B petition.
Yes.
