Regrding change of status from H4 to approved H1

Hi,

I was on H4 and I have got my H1 visa approved oct-2012. I have a question that

what is my status now? is it H4 or status is changed to H1?

If not changed can I go out of country and come back on H4? If so what abt H1 visa status?

do I need to apply for COS after coming back?

And due to some reason I can not start working immediately. I need to travel to India and start working once I’m back. So if I goto india do i need togo for stamping?? And without offer letter getting H1 stamping done is hard. It is all deadlock condition.

Please give me some suggestion ASAP, so that i can start working once I’m back to USA.

When your H-1 approved, did it arrive w/ an I-94 attached to the bottom of it? If yes, then your status has changed to H-1 from that approval date and you were supposed to work on H-1 from that date. It also means you are out of status as you are not manitaining H-1 status.

If no I-94 is attached, then you are on H-4 status. You can move to H-1, either by filing COS from H-4 to H-1, or entering US on stamped H-1 visa.
