Regarding EB1 eligibility for returning employee (Multinational Executive or Manager Green Card)

Hi,

I’m currently a Senior Manager with my company where I worked for 15+ years. I have 1+ offshore managerial experience and qualify for international manager requirement although as per my company policy, I will be eligible for EB1 upgrade after I get promoted to Director. I now have a offer from an external organization that I would like to accept. Am I eligible for EB1 upgrade if I join the other company and return to my current employer in a higher organization after some time at the Director level? Please advise.

The basic requirement for EB1 eligibility is that your should have worked off shore with your sponsoring employer in managerial position for at least one year in the three years preceeding the filing of EB1 I-140.

Thank you Kalpesh. Yes, I worked for one year in the recent three years. My doubt is I leave my current company now and return after 1 year or so. Will I still be eligible as I was continuing the services with the company. Please advise. Thank you.
