Reactivate my H1B Visa

Hi, I was on H4 visa and applied for fresh H1B visa while I was in US. My H1B visa was approved on 10/01/2014 but was only valid until 11/01/2015. I worked with my employer in US till 08/31/2015 and then traveled back to India. I am currently in India and my H1B visa is expired now. I never had my visa stamped as I had applied H1B from US only. I have few questions-

  1. Is my Visa still valid? Can I reactivate it?

  2. Does it need to go through CAP process again?

  3. If I can reactivate my visa then can I change the employer in India and can my new employer file the extension or I need to travel with my existing employer who had filed visa initially?

  1. Yes

  2. No need to go through the cap again

  3. Any employer can file a cap-exempt petition for you by submitting old approval notice as proof of having made through the cap. Once approved, you can appear for stamping carrying that new petition and then travel to US to work for that employer.

Thanks a lot Saurabh. This is very helpful.
