Query on H1B extension & petition validity

Hi,

I got H1 petition in 2007 (Valid from 10/1/2007 until 09/28/2010), and got visa stamping in 2008, but never travelled to US on this visa. I worked in US for 1 year on L1 from 2006-2007 Aug.

Now i got a job in US, so Can i file for H1 extension & transfer since the petition is valid for 6yrs? Or do i need to go for fresh petition FY 2014?

You can file for a cap exempt petition and do not need to wait for this year’s quota.
