Queries on H1B transfer without visa stamp and without US move

Hi,

Have few queries as follows on H1B visa transfer from India without enter into US and without visa stamping.

I am working in India with company A. I got H1B petition approved with company B. Now my queries are follows :

  1. How much tentative time will take for transferring a approved petition from one employer to another (in my case company B to company A) if I am already in India and no visa stamped yet ?
  2. If I get my visa stamped now with company B and later if company A get H1B transfer approved, do I need to go for visa stamping again or I will be OK to use same stamped visa ?
  3. In copy of form I-129 which I received from company B, he mentioned intended employment from 10/1/2015 to 08/30/2018 but till date I have not apply for visa stamping. Now I am planning to go for visa stamping by Jan first or second week so is there any document required from company B about new start date for employment ? or am I OK to go with same documents which stating 10/1/2015 is employment start date ?

  1. Cap-exempt petition (aka H-1 transfer) could take 2-6 months under regular processing.

  2. There is no requirement to get it stamped through A as long as B’s visa stamp is valid and has not expired

  3. If you can get more recent documents (like offer letter etc) then that would be helpful. If not, go w/ what you have as they would still be less than 6 months old.

  1. How we can expedite transfer process ? Is that available for everyone ?
  2. How much time approx will take if company A will initiate L1 visa for me ? Is there any possibility L1 visa process will take lessor time thn H1 transfer ?

  1. There is an option to upgrade to premium processing. It would then be done in 2 weeks

  2. L-1 may take few months time as well.

The same job cannot qualify for both H-1 and L-1 as both have different requirements.
