Premium processing petition undergoes lottery or not ????!!!

Hi,

I believe there is confusion on Premium/Regular processing of H1B filing. Can some one explain clearly on below:

For example we have below scenario, where 4 candidates filed for H1B 2016.

Question - Does all these candidates under go lottery process or not?

Candidate A - Premium - Selected in lottery

Q - When he will be notified on his selection? What are the next steps.

Candidate B - Premium - Not selected in lottery

Q - When he will be notified on his non selection? What are the next steps.

Candidate C - Regular processing - Selected in Lottery

Q - When he will be notified on his selection? What are the next steps.

Candidate D - Regular processing - Not Selected in Lottery

Q - When he will be notified on his non selection? What are the next steps.

Everybody has to go through lottery if the number of petitions exceed the cap (20,000 for Advanced Degree & 65,000 for regular). Premium processing has nothing to do with the lottery.

Premium processing does 2 things:

If selected in lottery, you will receive e-mail receipt and paper receipt. (Only paper receipt for regular processing)The petition will be adjudicated in 15 business days. (i.e. a decision will be made with the petition in 15 days unless there is a request for RFE) Candidate A - Within 2-4 weeksCandidate C - Within 3-6 weeksCadidates B & D - Probably in 8 weeks
