I am on H1 B Visa right now. And my employer is ready to file for my GC. My lawyer gave me 11 years of time to get GC. He also mentioned that if I go back to India after filing GC my file will countine and I can coem back to US once my GC is approved. This sounds fishy to me. Please let me know if I can do that. You may continue to travel on a valid H1B or L visa while green card is in process stage 1. If your H-1B expires while abroad, it ceases to be a travel document. When you enter adjustment of status phase (I-485), an advance parole form I-131 needs to be filed for travel and reentry but that is if you are in the US at time of approval. Your lawyer is right in that when form I-140 is filed and approved, beneficiary may opt for adjustment of status (meaning you are in the US) or consular processing (meaning you are abroad) where you will be interviewed via an I-824 step including medical check up. Yes, the process continues regardless of where you are.
