Hi,

I am on H1B transfer with receipt notice. I received “Notice explaining USCIS actions was mailed”.

My employer received notice and it is mentioned as “Notice of Intent to Deny”. The reason is beneficiary previous H1B i94 expiry is 11/2018 and transfer started on 12/2018. He is out of status for 30 days.

My previous H1B i94 epiry date is 11/2019. Attorney said it was a error my from USCIS officer who took action.

Any suggestions?

Your attorney is RIGHT. Properly respond to the NOIR, it would fix your issue.

what was the update in your case

It was a mistake by the officer who was looking into my case. We sent all the docs as proof of my legal stay and the case was approved.
