Non cap H1B filing using old H1B petition number

Hi,

My H1B got approved in the year 2012 with one year. I came to US under F1 Visa in 2013 .If i apply for H1B, whether Non cap H1B filing allowed for my case using old petition number. If it is possible, whether we need to file new H1B using old petition number or H1B transfer.

Request your advise on this regard.

Yes, you may file under non-cap as you already have an approved H1b. You will have to use the old petition number and attach a copy of it, when you apply. Just mention it to your lawyer, he will take care of it for you.

I went to VISA stamping at that time and it had been stamped for one year . Whether it will restrict in applying H1B under non cap?
