I am on L1 visa valid till july 2014 and my company filed a new H1 B petition for me (without COS) but for personal reasons i dont want to switch to H1 visa until july 2014. My h1 visa is picked up in the lottery and its in initial review state now. I cannot convince my employer to withdraw it back. Please suggest if Leap frog option would work? if so please elaborate more about the leap frog option. Thanks
If it is filed w/o COS then you don’t need to do anything. Leap frog etc will be required only if COS has been filed. You will remain on L-1 status even after H-1 gets approved as COS was not applied.
