Need info H1B Amendment

My employer didn’t file my H1B amendment, required for change of work location. I am working in DE and my H1B was filed for NJ.I am going to India for stamping and I need some additional information.

When my H1B was filed I was not aware to which client I would be working for. I am currently working in DE and this is my first client , first vendor and first job in the US.

  1. Do I need to file an h1b amendment for stamping?

  2. If my employer provides me with new LCA will that be sufficient?

  3. If I apply for H1B amendment what would be the cost in regular processing and how long will it take?

  4. If I go by premium processing what would be the cost and how long will it take?

  5. Do I really need an H1B amendment since this is my first client and first job?

  6. What are the consequences if we do not file for an H1B amendment.

  7. What are the support docs do I need to carry at the time of stamping?

Your employer needs to secure new LCA with your current work location and must meet the priviling wages condition of the updated work location. No need for H1 amendment.

Without a valid LCA, underlying H1B is invalid. In other words, technically your current H1B is invalid.

Ask your H1B employer to get the updated LCA ASAP and then only go for stamping.
