Need help on changing job - on H1B Visa

Hello members,

I am currently working for a IT concern in US on H1B Visa. It’s been almost 4 months now. I do not seem to like the job because I was promised a different kind of a position and the kind of job I am made to do now is very different, doesn’t really match my specific skills and it feels like I am forcing myself to perform.

I am thinking of taking the hard decision of switching my job here. I have switched jobs in India a few times, and I know how it works there like the entire process. But I have no idea how it works here. Is it the same way? Also, I am just 4 months into US and if I change now will there be any problems from the Visa end?

I would be really obliged if someone can share some information or experience.

Regards,

John

Switching job is a very straight forward process in US. You get a offer from new and then put 2-4 weeks notice with your present employer. You can leave the same day also but you should always part away from your present employer on good terms. Never say bad thing during the exit interview or when asked for reason for leaving.

A short email to your Manager is enough to resign from present company.

Now since you are on H1-B, you and your new employer have do so H1-B transfer before you can switch job. The process is -

  1. Get a written offer and accept it. If you don’t like any terms in offer talk to them and they might be able to accomdate it.

  2. Your new employer will start you H1-B transfer process. You will have to give then a copy of present I-1797, Salary slips, passport copy etc.

  3. Once you get the receipt for H1-B transfer from USCIS you are free to switch jobs or you can wait till you get the H1-B appoval with new employer.

You can have multiple valid H1-B under your name with different employer but can only work for one employer. If you decided to the stays back with your present employer just tell the new empoyer that you have decided to stay back.
