Need Help - H1B Cap- Exempt: unused H1B petition

Hi,

I had one unused H1B petition which expired in 2011(I even didn't went for stamping). Can I apply for cap-exempt for this year?

As per I-797B, Receipt Date is April 23, 2008. So i think my H1B is approved on April 23, 2008.

Kindly let me know that can I apply for cap-exempt now.

U are cap exempted till april 23 2014. Apply asap

My unused H1B Petition validity: 10/1/2008 to 9/29/2011.

In my case what is the last date for applying under the Cap-Exempt category.

Its counted from date of approval, but not date of stamping… 6 years from ur approval date
