My wfie applying or F2 visa

We got married in May 2014 but the marraige was not registered so we do not have a marraige certificate.

Later we independently applied for the F1 visa for US. She got her passport on her fathers name.

I got the visa and she was rejected. She appeared a total of 4 times, rejected every time. Thrice from mumbai and once from hyderabad.

Presently I am in XXX university in my first semester and she back in india al alone.

Now we are planning to make her apply for the F2 visa.

-Would her rejection on F1 have any impact on F2 application ?

-Do I need to go back to india to register the marraige ?

-Do we need to get a new passport of her’s on my name ?

-What are the documents and financial condition required for the application ?

-When is the best time to apply for the F2 visa as the last rejection was on March 09 2015 ?

-What are the chances that she gets the visa ?

You may need to. Marriage certificate is the most critical piece of information that proves your relationship with your spouse and it is mandatory for your school and the consulate. Also, your school may ask you to submit funds proof for your spouse as dependent. Check with your school on this.-Do we need to get a new passport of her’s on my name ?

There is no specific time on this. You can apply anytime as both are different visas. -What are the chances that she gets the visa ?

Getting visa depends on various factors, it is hard to tell. As long as you have everything right, it should not be a problem as it is a dependent visa.

Should i try once more for F1 and then try F2 if rejected. or should directly go for F2 …
If i go for F2 the visa officer will think that the girl wanted to go to US so kept on trying for F1 and finally …she got married to a boy on F1 status just to go to USA. Is this possible…??
Or it does not matter as we will be husband and wife.

Sorry to hear about your situation. F-2 category is the most common for rejections because an F-1 student does not meet financial stability criteria even if you show a good bank balance. Please note that an F-2 is considered a financial burden on an F-1 and there is a very high risk of her becoming a public charge, hence the denials. Having funds in foreign bank accounts does not help this matter. However under family unification rules, she will be allowed to visit you on a B-1 visa but this needs support from your district’s senator. There is one additional option - if you are approaching the last semester of your education, F-2 may be granted so that your wife can be there to support you through graduation and not much time is being spent by her in the US.
