My status after H1B Petition Approve or reject.

Hi,

I came to US with L1B in month of May 2011, but my visa got expired in Nov 2011, but my I-94 expires in 2014.Currently I am working in US with my I-94, and my company filed H1B visa for 2012-13 regular quota.

Current status - Waiting for Approval


1) If my petition gets approved, with immediate effect I will be considered as H1B visa holder or until I get it stamped?

2) If my petition gets approved, will my I-94 dates become invalid?



3) If my petition gets rejected, we need to go back immediately or I can continue working with my old I-94.

    IF YOUR EMPLOYED REQUESTED BOTH CHANGE OF STATUS (COS) AND EXTENSION OF STAY, YOU WILL BE AN H1B HOLDER EVEN WITHOUT STAMPING, ALL THOUGH, YOUR EMPLOYER MAY HAVE REQUESTED, IT’S UNDER USCIS DISCRETION TO PROVIDE AN I-94, IF THEY JUST APPROVE WITHOUT I-94, YOU WILL NEED A STAMP.

    YOU NEW i-94 BECOMES VALID BEARING THE SAME I-94 NUMBER

    1. If my petition gets rejected, we need to go back immediately or I can continue working with my old I-94.

    YOUR EXISTING STATUS WILL HAVE NO EFFECT, YOU MAY CONTINUE TO WORK
