Minimum time line apply for H4

Hi,

  1. My H1B visa expiring on September 30th 2016. Is there any minimum timeline for my spouse to enter US. Is it like before 1 or 2 weeks before H1 visa expiry she should enter US or else she wont be allowed.

  2. When my VISA extension application work in progress, shall my spouse can go for H4 Stamping with my available approved visa.

Please clarify at the earliest.

  1. Advisable to enter USA at least a month before your H1B expiry.

  2. If your H1B status is not expired she can go for stamping regardless of whether your extension is in progress or not.But if your extension is in progress and I94 already expired , she has to wait for your extension approval before she can go for stamping.
