LCA Amendment and H1B Amendment

Hello All,

I think someone can guide me.

My employer X filed H1B and LCA for a client in Memphis on Apr 2013 and it was approved and couple of months before i and my wife went for interview and H1B stamped for me and my wife got H4 stamped. I was initially offered 52K .I have not yet travelled to US as i was waiting for my date.

My employer returned to me saying there is a change in client and new work location is Milwaukee. Iam pretty sure that i need to do LCA amendment as there is change in work location. However my salary is now increased to 100k , but there is no change in nature of work /job duties/ responsibility / even title change

Here are my questions

  1. How long it takes for LCA amendment and whats the % of denial and whats the cost ?. What all i heard is that LCA amendment after stamping will be usually smooth.

  2. Should i do H1B amendment as there is a material change ie Change in Salary ?

  3. If yes How long it takes for H1B amendment and whats the % of denial and whats the cost?

  4. Any legal formalities for my wife H4?

Iam deifnitely not willing to travel, till my paperworks are perfect

  1. New LCA should be certified within 10 days and I don’t think DOL charges anything for it. Attorney fees is separate.

  2. Yes, this requires H-1 amendment as a new LCA has been cerified.

  3. H-1 amendment can take 2-3 months. Chances of approval vary from case to case, and primarily depend upon the submitted documents.
