L2 Gap to H1B 2025

Hi,

I am currently on L2 Visa and working and was picked in the H1B lottery. Our L1 and L2 visa ends on 25th August 2025 and we cannot extend further as our extensions are completely. My husband was not picked in the lottery in any attempt but i was picked this year. I understand the H1B starts only in October 2025 and i have a gap from August 25 to 1st October 2025.

What is the best way to handle this situation ?
Is it preferred to do premium processing in my case in order to start on October 1st, 2025 and do the necessary documentation in US like driving license and so on.
Will i be able to change of status or do i need consular processing if i stay back ?

Talk to your employer’s immigration lawyer. They may be able to ammend H1B and request change of status before your current status expires. The gap may be considered period of authorized stay based on approved H1B.
