L1B to H4 while L1B extension, i94 expired

Hi,

Currently i am in US on L1B visa, and my visa is expired in May 2014 but i have valid I94 till end of April 2015. My current employer is filing extension for my L1B visa, just in case if my L1B extension is rejected in next few months, can i apply for H4 visa (my wife is on H1) without leaving USA? What are the chances for me to continue staying in USA?

Actually you have some chances to stay in USA when you apply for H4 we can provide the I94 as soon as possible
