Hi,

Currently I am working in US from Company A with L1B 2016 and I have H1B from Company B from the year Oct 2015 which is never used. now I wanted a clarification, if I get opportunity to work for Company C, whether Company C can transfer my H1B as currently do not see any opportunity with Company B.

Oct 2015 - H1B (never used) - Company B

May 2016 - L1B (Currently Active) - Company A

Note: H1B was applied when I was out of US.

C can file a cap-exempt petition along w/ COS from L-1 to H-1 for you. They will be submitting copy of B’s approval notice to show that you have already made through the cap. They will also need to submit A’s payslip, I-94 and I-129 copy to show that you are in valid L-1 status.
