To be eligible for L1 visa, it seems you have to work with employer for at least 1 year in past 3 years. I was working with my ex-employer for 4 years and then resigned and came to US on H4 visa. Now after a gap of 8 months , my employer has approached me as there is a job opportunity in company’s US office. Will a gap of 8 months prevent me from applying L1?Will I be eligible to apply for L1 while I am in US?
The USCIS rule is clear in this matter: “The emplyee generally should have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States” And yes, you do not have to be in home country to apply.
