L1 to H1 COS - clock reset applies?

Hi Saurabh,

I worked on H1 for 3 years from 2006 to 2009. After one year gap, came to US on L1 in 2010. If I transfer my previous H1 to new employer with COS, can I get new I-94 validity for another 3 years using clock reset as I stayed outside US for 1 year? OR I get only 6years minus combined H1 & L1 stay?

Your clock has been reset you can get another 3 years

Actually the clock is not reset if you use the previous H-1 petition. If the new employer files against the new cap then your clock is reset. If the new employer files cap-exempt petition using previous petition, then your clock is not reset.
