l1 and l2 is expiring on sept 24 and h1 is effective from oct 1

Hi All,

Me and my spouse are on l1 and l2 visas (valid till 24th sept)and currently in USA. We are trying to apply h1b thru a desi consultant and he says to appply h1b from usa the l1 -l2 visa should be atleast valid till oct 15th.

Why is he saying so?

Better to find an employer in US… U dont even need to get it stamped if so

If applied thru US, employer will file h1 with COS, which if approved U can start working immediately from oct 1st, U dont even need to go for stamping to home country. Also there are high chances of approval if u file thru employer directly from US rather than thru desi consultancies

Hi Thanks for the clrification…
The desi consultancy is in USA only.So I believe they will be applying from USA.
Its really difficult to apply thru a company as I dint find any company sponsoring for myself. our l1 and l2 visa will get expired on sept and even we might travel on our own expenses to India before Oct. we are ready to bear our own travel expenses.
Some consultants told that that if l1/l2 expires by sept 15 then its ok for them to file but ours is expiring on 24th of sept and one consultant told that l1/l2 should be valid atleast till oct 15.
