How can I verify the LCA created by the employer is related to the employee getting selected in H1B lottery. ?
Suppose a Employer has got 10 employees selected as part of the H1B Lottery selection process.
Can the Employer file LCA for 15 employees (10 real + 5 fake employees).
Does the LCA process allow this ? is there any way to verify LCA is mapped to the right employee ?
LCA is not tied to specific prospect employee i.e. there is no mention of employee name in the form ETA9035.
LCA can be requested for number of employees however no names are mentioned so yes the employer can file LCA for 15 employees for specific positions but may only submit for the employees that the employer will file H1B petition application for.
