If I switch a company do my spouse has to go to India for H4 stamping?

I have two questions:

  1. If I am working in ABC company(H1 visa- ABC employer) and switch to XYZ, then my H1B will be transferred and I dont have to get it stamped as long as I am in US but my wife has to go to India to get it stamped immidiately? Please correct me if I am wrong.

2)H1-B petition under exempt quota got denied for one of my colleague, he(his employer) is reapplying under exempt quota. Is it true that if H1 petition gets denied for 3 times in a row you cannot re-apply for another 3 years or so?

  1. If she already has a H-4 visa stamp in her passport, then no stamping is required. Else she has to get it stamped through your current employer at that time.
