I140 (prev emp). H1 (new emp), did not use in I140 for H1. H4 EAD?

Hello,

I have approved I140 from previous employer (still not revoked). I was on L1 with previous employer for 3 years

I left previous employer, did my masters in F1 and now I am on H1 with new employer. When we applied for H1, we DID NOT USE I140 to claim 3 year extension.

Can we still use I140 from previous employer for applying H4 EAD even tough it was not used for applying H1?

Yes, as long as your i140 is not revoked and active, you can use it.

Side Q: Why you didnt use that i140 to renew your H1 for 3 years? You can use it, regardless of its from a different employer. It doesnt hurt your H1 extension

Thanks ImmiGeek! I didnt use it because at that time my previous employer didn’t provide a copy.
Now I got a copy from USCIS using FOIA.
