I applied my H1B last year but had to cancel the visa since I had to travel out of country for a period of time. Now I am back in the States on H4 visa. With the H4 EAD rule to be passed, I want to know if I would be eligible to apply for the H4 EAD inspite of my cancelled H1B. Please advice.
The H4 EAD is applicable to you if your husband’s I-140 has been approved. Cancellation of previous H1b visa should not have any effect on your H4 EAD.
