I did not use my H1B visa issued from Feb 23rd, 2009 to Sep 26th, 2011. Am I eligible for cap exempt?

Hi,

I am currently living in India. Due to some family reasons, I did not use my H1B visa to come to US in 2009. If I want to come to US, Do I need to wait until April 2015 to apply for H1B? or Am I eligible for cap exempt because I did not use my visa at all?
If I am eligible for cap exempt, what do I need to do to get new visa?

It can be done anytime, U dont need to wait till April 2015
