I am on H4 EAD and have an I-140 approved status myself. Will that remain active

Hi

I was on H1 for almost 4 years and applied for Green card process. I have my I-140 approved with a priority date of Feb 2012. Once I got married, I changed to H4 EAD as my husband has an approved I-140 with a priority date of July 2012. I wonder if my I-140 still remains active and once my priority date becomes current I like to process my I-485.

Please advise. Thank you!!

If your previous employer has not revoked the I-140 then you can use it to file I485. You might need a letter from them stating that they are still willing to offer you the same position as was mentioned on the PERM
