I am laid off - have i140 approved but my H1B is going to expire

I got laid off. I have i-140 approved (EB2) and my current H1B expires on Apr 20th, 2024. However - my former employer filed for a H1B extension on Feb 20th, 2024 and this should take some 1.5 to 2 months to complete.

  • Since i am in hunt for the job market - do i only have time till Apr 20th? Or is my status still active? If yes, what is the duration?

  • I am currently on my 2nd H1B term at this time (6th year)

  • My drivers license expires on Apr 4th 2024, Can I still use my existing I-797 documents for the same?​​

@Kumar : Kindly share your feedback. Looking for your expert opinion. My former employer will not withdraw the I-140.

My former employer filed for H1B extension on 2/20/2024 and this will take some 1.5 to 2 months for approval.

Once laid off, you have 60 days grace period to look for another job and transfer your H1B.
