I want to apply for a study visa but also my uncle has applied for a f4 visa for my mother in 2009 , will this be a problem for my f1 application?
Someone told me that this is a huge problem.
Is this true ?
I am assuming that the uncle you are referring to is your mom’s biological brother. An F-4 family preference visa can take anywhere from 4 months to 20 years depending on your country of origin with Europe preferred over Asia. If you have plans to study abroad, you should apply for F-1 visa. Even if you are a named dependent in your uncle’s F-4 petition for your mom, it is still a pending application. Please say ‘no’ where it asks in your F1 DS 160 if you have ever applied or has anyone ever applied on your behalf for US permanent residence because you have not done so. Your mom can’t answer ‘no’ to this same question in any visa category because someone has already applied on her behalf.
