H4 Not filing by New employer as he says I-94 is valid for more than 1year

Hi,

My New Employer is saying about H4 Visa filing for my dependants as follows:



Since employees dependant I 94 is valid for more than one year(Oct 2014) we are not filing  H4 for them they can stay with same petition  in US.



 Will there be any problem during entry/exit or stay in US for my dependants on H4?

Currently it will not create any problem, if your dependents are USA. But better it can be converted.
