H1Transfer-pending RFE

Hello All,

I have valid I94 till Oct 2016.

Current employer started Amendment and extension in advance. Got RFE for that.

Received another offer and want to start H1B transfer in premium.

Is it possible to initiate H1B transfer for new employer when existing employer RFE is pending ? Do you foresee any issues for new H1B transfer ?

I assume your current 797 is also valid till Oct 2016.

As you are maintaining valid H-1 status (valid I-94, valid 797, getting paid), H-1 transfer can be applied. Still, you should inform the new employer about the current RFE.
