H1B: What is the proper form(I-797A vs I-797B)for people not in the USA

Dear Saurabh,

   Please help me. I am currently in India. My H1B (new) petition was approved last month. I have got the papers from my employer recently. The approval notice form is I-797A (not I-797B). I don't have a L1 Visa. I have a B1/B2 visa.



According to the USCIS website,



"I-797A is Issued to an applicant as a replacement Form I-94"



"I-797B is Issued  for approval of an alien worker petition"



Could you please tell me If the I-797A form is fine for my case (new petition, outside USA)?  



If something wrong with the petition filing, will I be eligible for Cap-exempt petition.
